1. About these terms

These Terms of Service (“Terms”) apply to your use of the Lottie & Grace online store and to any purchase you make from us (“we”, “us”, “our”). Together with our Privacy Policy, Shipping Policy and Return & Refund Policy, they form the agreement between you and us. By using our store or placing an order, you agree to these Terms. Nothing in these Terms limits any right you have under the consumer protection laws of your province or territory that cannot be excluded by agreement.

2. Eligibility

You must be at least the age of majority in your province or territory to place an order, or use the store with the involvement of a parent or guardian.

3. Products

We do our best to display our products, colours and sizes accurately. Colours may look slightly different depending on your screen. Product descriptions, availability and offers may change without notice, but changes never affect an order we have already confirmed.

4. Prices and payment

All prices are in Canadian dollars (CAD). The price you pay is the price shown at checkout when you place your order, including any shipping charges and applicable taxes shown before payment. Orders are shipped Delivered Duty Paid, so you will not pay customs duties or import fees on delivery. If a product is listed at a clearly incorrect price, we will contact you before shipping and you may choose to proceed at the correct price or cancel for a full refund, unless the law requires us to honour the listed price, in which case we will.

5. Orders

After you place an order, we will email you an order confirmation containing the details of your purchase. Please keep it for your records. We may decline or cancel an order (for example, if a product is out of stock or a payment is suspected to be fraudulent); if we do, we will notify you and refund any amount paid in full.

6. Promotions and discount codes

Promotions, bundle offers and discount codes are subject to the conditions shown with the offer. Unless stated otherwise, only one discount code can be used per order, codes cannot be exchanged for cash, and offers are valid while stock lasts.

7. Delivery, cancellation and returns

Delivery times, cancellation rights and returns are described in our Shipping Policy and Return & Refund Policy. Ownership of and risk for products pass to you when they are delivered to you.

8. Warranties

Our products come with the warranties and conditions provided by applicable law, including those under provincial sale of goods and consumer protection legislation. We do not exclude or limit those legal warranties. Apart from them, and to the extent permitted by law, our website and its content are provided “as is”, and we do not guarantee that the website will always be available or error-free.

9. Limitation of liability

To the extent permitted by law, we are not liable for indirect, incidental or consequential losses arising from your use of our website. This section does not limit our liability for defective products, for our own negligence, or for any liability that cannot be limited under the consumer protection laws that apply to you.

10. Your account

If you create an account, you are responsible for keeping your login details confidential and for activity under your account. Please tell us immediately if you believe your account has been used without your permission.

11. Acceptable use

You agree not to use our store for any unlawful purpose; to interfere with its security or operation; to upload malicious code; to scrape, copy or resell its content; to submit false information or impersonate anyone; or to place orders for commercial resale.

12. Reviews and feedback

If you submit a review or other content, it must be honest, reflect your own experience and must not be unlawful, offensive or infringe anyone's rights. You grant us a non-exclusive, royalty-free licence to use, reproduce and display it in connection with our store and marketing. We may remove content that breaches these Terms.

13. Intellectual property

All content on our store, including text, images, graphics, logos and designs, belongs to Lottie & Grace or its licensors and is protected by intellectual property laws. You may not use it without our prior written permission, except for personal, non-commercial viewing.

14. Third-party services and Shopify

Our store may link to or include tools from third parties, which are governed by their own terms. Our store is powered by Shopify. Any sales and purchases you make in our store are made directly with Lottie & Grace, and Shopify is not responsible for any aspect of those sales.

15. Governing law

These Terms are governed by the laws of the province or territory in which you reside and the federal laws of Canada that apply there. You may bring any claim before the courts of your province or territory of residence.

16. Changes to these Terms

We may update these Terms from time to time. The version in force when you place your order applies to that order. Updated Terms will be posted on this page with a new “Last updated” date.

17. General

If any part of these Terms is found to be unenforceable, the rest remains in effect. Our failure to enforce any provision is not a waiver of it.
